Terms and Conditions of Sale

 

The following terms and conditions are presented, as illustrated, to each customer and must be agreed to by every customer who purchases meals from The Whisk and Spoon.

 

Before your new account can be created, we ask that you, the customer of The Whisk and Spoon, LLC, agree to the following terms and conditions:

 

• I will promptly freeze or refrigerate my Whisk and Spoon meals after picking them up. I will refrigerate all food items to a temperature below 41 degrees F. (Always use a refrigerator thermometer to make sure your refrigerator is set to the appropriate temperature).
  
  
• I will always wash my hands with warm, soapy water before preparing and eating food.
  
  
• I will follow the cooking instructions set forth on the Whisk and Spoon cooking label included on each meal. I will follow the cooking instructions as specified for each meal. I will heat all dinners to the appropriate internal temperature as instructed. (Always use a meat thermometer to check the temperature and ensure doneness while maintaining taste and flavor).
  
  
• I assume full responsibility for the transportation, proper storage, defrosting, and re-heating of all of my Whisk and Spoon meals and I acknowledge that Whisk and Spoon will not be responsible for any loss or deterioration which occurs subsequent to my pick-up of the meals.
  
  
• By creating this account and in consideration of the meals I will receive from Whisk and Spoon, I hereby  release and forever discharge Whisk and Spoon, its directors, officers, stockholders, employees and agents from any and all present or future claims, demands, causes or actions, liabilities, damages (whether direct, indirect, incidental, punitive and/or consequential), fees, costs, expenses and compensation of any nature whatsoever, whether based on a tort, contract or any other theory of recovery, both in law and equity, which I may have now or in the future against Whisk and Spoon including without limitation any claim, demand, or cause of action for any injury, sickness, loss, or damage caused by, resulting from or in any way arising or growing out of the use of this site or the preparation, storage, freezing, refrigeration, defrosting, re-heating and/or consumption of Whisk and Spoon meals.
  
  
• I hereby acknowledge that any information provided by Whisk and Spoon is not a substitute for the advice and recommendations of health professionals and that I should always consult a health professional prior to any decision regarding health concerns or my diet.  I further acknowledge that Whisk and Spoon meals may contain food products or by products to which I may have an allergy, including without limitation, peanuts.

• The information given while registering on our site (your e-mail address, phone, and physical address) will not be disclosed or sold to third parties, it will be used only for effectively servicing you as a customer of Whisk and Spoon.
